Our property attorneys have the requisite knowledge, experience and proven capabilities to handle property transactions of all levels. We regularly advise on sale and purchase of real estate, strata law and community declaration, letting and sub-sale, tender processing and auction bids and litigation. We have acted for large property large developers in Dubai and Abu Dhabi and also advised on large turnkey projects, development and management rights, strata and jointly owned property schemes, financing arrangements and handover procedures.

Real Estate Due Diligence and Joint Ventures

Our lawyers carry out a detailed assessment of all material documents prior to engaging in due-diligence of real estate projects. Within the scope of such due-diligence we cover a detailed analysis of the risks and key changes necessary for a peaceful hand-over operation. Our due diligence is extensive and includes necessary inquiries with government authorities, land department, escrow agents and insurers as well as banks who work with relevant parties to assess and understand the required data and information.

Our team has been involved in carrying out the drafting and reviewing of real estate projects including residential, mixed use, man-made island and townships. We have undertaken drafting of all third party agreements, including sale purchase agreements, leases, addendum(s), complex rules and regulations and accompanying agreements.  STA’s team of property lawyers are highly skilled in bringing together parties with diverse synergies, strengths and objectives. We provide bespoke advice to our clients on broad range of matters including structuring of ownership entity, documenting joint venture relationships, devising management contracts, negotiating the contracts and providing necessary consultancy in relation to joint venture projects.

Within the Emirate of Dubai, the government introduced the Jointly Owned Property Law, Law No. 27 of 2007 (the Strata Law). We have expertise in drafting documents relating to the Strata Law including advisory on the importance of the owner’s association.

Real Estate project ongoing and close out issues

Our lawyers work closely with the construction teams and handle the on-site assembly (including statutory procures such as CPO and appropriation), planning, negotiation with third parties, including investors, contractors, and consultants, thereby finalizing the relevant arrangements between each of the parties and ensuring that the framework is independent, transparent and free from any discrepancies. We ensure that every transaction is completed in the most cost effective manner, and aim to resolve differences that may otherwise give rise to complex and expensive litigation.

Real Estate litigation

Our attorneys represent a sizeable number of investors and significant corporate houses in matters of litigation before the courts. Our attorneys are licensed to practice before most local courts throughout the United Arab Emirates including Dubai, Abu Dhabi and Sharjah. We also handle matters before the arbitration centers in different jurisdictions and have won successful awards on behalf of our clients.
